The laws of California relating to drunk driving are very complex and can be found in the statutes of the California Vehicle Code. However, the basic laws define two separate offenses: driving under the influence of alcohol and/or drugs (Vehicle Code Section 23152a) and driving with a blood alcohol concentration of .08% or higher (Section 23152b). In most cases, a person arrested for drunk driving in California will be charged with both crimes. There are dozens of additional DUI-related statutes in the California Vehicle Code, most of which provide for such things as second and subsequent offenses, driver’s license suspensions, penalties and DUI causing injury or death.
